The Client understands that while the trainer will provide their best recommendations and assessments when providing services, they cannot guarantee that the dog will have success or consistent performance now or in the future. The Client understands that they must continue to work with the dog in order to improve and maintain the dog’s behavior in the future. The Client understands that failure to do so will likely result in regression of the dog’s skills. The trainer is not responsible for lost, misplaced, or damaged personal belongings (including but not limited to dog leashes, collars, harnesses, toys, and other items belonging to the Client). The Client expressly acknowledges and understands that the trainer’s services may be provided in an environment where certain hazards may exist including but not limited to, debris in the area, other animals and their owners, stray animals, wildlife, training equipment, traffic, uneven terrain, water, illness, and other natural hazards. The Client expressly agrees to indemnify and hold harmless the trainer and to pay all losses and damages suffered or incurred, and to defend and indemnify the trainer from any claims, demands, lawsuits, losses, costs, or expenses, including attorney fees, arising out of or in connection with the provision of the trainer’s services to the Client and/or the dog. The Client assumes the risk, should the dog be injured in any manner, including fight or altercation with another dog or animal, or accident, gets fleas, ticks or parasites, contracts any illness or disease, be lost or stolen, become pregnant, or engage in any dangerous, vicious or unwanted behavior, during or after the term of the contract, on or off the Client’s property, or any other location deemed appropriate by the trainer, and agrees to hold harmless and release the trainer for any resulting injuries, losses, damages, costs, or expenses. If the dog causes property damage, or bites or injures any dog, animal, or person (including but not limited to the trainer, the Client, and the Client’s family members), during or after the term of this contract, then the Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the trainer from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If the Client or Client’s family members causes property damage or injuries to the dog, animal, or person (including but not limited to the trainer, the Client, and the Client’s family members), during or after the term of this contract, then the Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the trainer from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. Force Majeure. Neither the Client nor the trainer shall be responsible for failure to delay in performing its responsibilities under this contract if such failure or delay is due to tornados, thunderstorms, fire, floods, drought, riot, war, or other acts of nature. At the trainer’s sole election, trainer’s services shall terminate if (a) in the trainer’s sole judgement the dog is too dangerous or unhealthy to participate in the trainer’s services, or (b) the Client breaches any term or condition of this contract. Upon termination in accordance with the foregoing, the trainer’s responsibilities shall terminate but all other provisions of this contract shall continue in full force and effect.
